Steve Hall på Adrants har skrivit en postning om Sara och L’Oreal. Problemet är inte bara att hans postning heter Swedish Woman Overreacts to L’Oreal Ad utan att han de facto snott den bild som jag tagit. Om han hade gjort det från min sajt kanske jag hade låtit det hela vara men återigen har herr Hall snott en bild från Adland. När man blir medlem på Adland går man med på sajtens copyright regler. Tyvärr är Steve Hall i bästa fall enerverande, i värsta fall en idiot. Så dab valde att skriva till honom:

Hey Steve. There’s a problem with your posting about the L’Oreal lady ad,
you are using an image that you do not have the right to use, and that
you did not ask for permissions to use.

The welcoming message that every member of adland gets carries a short
reminder as well, which you did get when you signed up as user “adrants”
April 10, 2001, it reads:
“Creative work is protected by copyrights and restrictions of use. Adland
respects the intellectual property rights of others. When you join as an
adgrunt you are bound by the terms of service, you acknowledge that the
creative work on the site is the property of others and is presented
solely for the purpose of evaluation. You agree not to duplicate this
material and that you will use it for research, information and internal
review purposes only.”

On behalf of photographer Niclas Strandh, whos copyrighted image you are
using without permission, I present this fee in accordance with Danish
laws on photographers rights.

2 * used without permission fee = +100%
3 * used without byline = +100%

sum total= 300 DKR , DKR means “Danish Kronor”.

In Danish legalese complete with points to which paragraphs have been
violated, I’m sorry for the language inconvenience here perhaps you
should just pass this on to your lawyer;

Gengivelsen er sket uden min tilladelse. Dette er i strid med
ophavsretslovens § 2.

Gengivelsen af min foto falder ikke ind under
lovens undtagelsesbetingelser, § 12 om ret til kopiering til privat brug
og § 22 om ret til at citere.

Overtrædelsen er særlig grov, fordi jeg ikke er korrekt navngivet
som fotograf til fotografiet, som det kræves i ophavsretslovens § 3,
stk. 1.

Herudover finder jeg det krænkende for min professionelle anseelse, at mit
fotografi optræder i en sammenhæng, hvor offentligheden kan forledes til
at tro, at jeg deler bladets synspunkter, hvilket ikke er tilfældet.
Herved krænkes ophavsretslovens § 3, stk. 2.

Jag var också tvungen att påpeka för honom att Sara inte är “the ordinary woman disliking ads”. Hans post låter lite som om hon inte vet vad hon pratar om – det han missat är att hon jobbar som barnombud i Västerås och har mer på fötterna än många av oss andra.
